General
- These Terms apply to all JUSC Medical websites and Medical Services. Your continued use of these websites and the services provided through JUSC Medical constitute your acceptance to these Terms and Conditions.
- Any reference in these Terms and Conditions to “us”, “we”, “our” mean “JUSC Medical”.
- JUSC Medical reserves the right to modify its Terms, Conditions and Services at any time.
Terms of Service
About JUSC Medical Services
- JUSC Medical provides specialist General Practitioner (GP) services via Telehealth using Doxy.me. JUSC Medical is a private health care service.
- To use our services you must be 18 years old or over or be accompanied by an adult. If you are not a New Zealand citizen, resident or visiting New Zealand you may not be eligible for funded prescriptions or investigations.
- Health care advice given through JUSC Medical is provided by a New Zealand Registered Medical Practitioner and Fellow of the Royal New Zealand College of General Practitioners. This doctor operates under the Code of Ethics.
- Following consultation, JUSC Medical will inform your General Practitioner of the consultation and of the medications prescribed (if any). If however you either do not nominate a General Practitioner or you do not give us the authorisation to contact that General Practitioner it will be your responsibility to inform your existing General Practitioner of any medications prescribed.
- Prior to the prescribing of some medications, your doctor may require you to have a physical examination or further investigations, for example: have your blood pressure checked or have blood tests done. Your doctor at JUSC Medical will advise you if this is a requirement prior to the issuing of any medication. A physical examination can be done during a ‘face-to-face’ follow up consultation at JUSC Medical or by your GP before certain medication can be prescribed.
- You agree that any product, medicine or medication that JUSC Medical doctors prescribe will be solely used for your own personal use and that you will not allow any other person to take, use or have access to that medication. You agree that if medication is provided or delivered to you that you will only take that medication in conjunction with any other medication that you have already disclosed to the JUSC Medical doctor prior to the issuing of the prescription. You agree that before taking any medication prescribed to you, you will read all information provided to you by your doctor, the dispensing pharmacist or by the manufacturer of the product and will follow that advice. If there is any conflict between the advice provided by your doctor and the manufacturer of the product or the pharmacist you must contact your doctor before taking the medication.
- If while taking medication you suffer any noticeable side effects that are causing you concern, you must re-book an appointment with your doctor at JUSC Medical to allow the medical practitioner to monitor the effect of the medications prescribed to you, or you must see your usual General Practitioner for advice. For urgent care, in New Zealand dial 111 and ask for the ambulance.
- If during the course of your consultation with JUSC Medical, transmission fails, your doctor may contact you by telephone in order to complete the consultation.
- If you use our video facility, you must not attempt to record the consultation, whether visually or by audio or take screenshots or copies of images of that meeting. You must not abuse, intimidate or threaten those people using the facility or engage in behaviour which is offensive. We reserve the right to terminate any consultation if you fail to comply with these Terms.
- In some circumstances, an online consultation will not be appropriate for your particular problem. JUSC Medical reserves the right to discontinue the provision of advice, or the prescribing or delivery of medication to you at any time. JUSC Medical may also withdraw, suspend or discontinue any of its services to you at any time without providing a reason to you.
- You agree that all information that you provide to JUSC Medical will be true and complete to the best of your knowledge, and that you will not intentionally omit to provide information that could reasonably be judged to be relevant to your doctor in providing their services to you. This includes any allergic reactions, or previous medical experiences or treatments.
- When attending a consultation, you agree you will be invoiced for the service delivered. JUSC Medical initial consultations will be invoiced and require payment before the consultation will take place. Follow up appointments and other fees will be invoiced afterwards. You are obliged to pay the invoice within the term set on the invoice.
- If you are unable to attend to your booked appointment, you must cancel or reschedule at least 24 hours in advance. Missed appointments without timely cancellation will be charged 50% of the consultation fees.
- If you do not pay your invoice within the term set on the invoice, JUSC Medical will send you an invoice reminder. If no payment is received a month after consultation, JUSC Medical will hold the right to use a third party Debt collector Agency, whom fees will be added to the outstanding account. When we are required to forward an invoice due to non-payment, you will automatically fall under the terms and conditions of our Debt collector Agency.
- As part of your registration with JUSC Medical, you are required to provide personal identifiable information. It is your responsibility to keep that information up to date with us so that it is complete and accurate at all times.
- You shall not impersonate another person while using the JUSC Medical Health care facilities. You shall not complete the questionnaires or have a consultation on behalf of anyone else other than yourself personally.
- You must take sole responsibility for the communications you make between yourself and the doctor JUSC Medical during the consultation. Doctor/patient consultations are private and protected by law, records will be kept of the consultation. Emails may be recorded by JUSC Medical for medical and legal reference. These records will be stored securely.
- Any emails or prescriptions are intended to be only read by the named recipient as they contain information which is medically confidential. It is your responsibility to ensure the security of your computer, emails and prescriptions.
- JUSC Medical stores its data and records in digital forms. JUSC Medical has a legal obligation to protect all patient confidential data. However, in order for JUSC Medical to provide its services, it must share some of the information you provide to them with other doctors, health professionals, and non-medical staff who may themselves store information about you in their own files. JUSC Medical reserves the right to use some of the information it collects, to verify your identity, for legal compliance, for financial and statistical information, for law enforcement, to facilitate court proceedings, to ensure the safety of JUSC Medical and its users, to enforce or apply its Terms and Conditions or to protect the property rights of JUSC Medical. It might also use information for internal research purposes, to maintain its website, as part of the payment protocols and for providing to you newsletters and promotions. Where JUSC Medical uses third parties to undertake services, it will require that third party to undertake strict precautions to protect your information against unauthorised use or disclosure. Your rights are protected by the Code of Health and Disability Services Consumers Rights, the Health Information Privacy Code 1994 and you have at all times the right to obtain and correct any information that we hold about you. About the services via Doxy.me
- JUSC Medical uses Doxy.me (https://Doxy.me) for the purpose of Telehealth consultations.
- By using Doxy.me for your medical consultation you agree to these Terms of Service and to the Terms of Service set by Doxy.me. If you do not agree to these Terms of Service, please do not use this service or website.
- Doxy.me works via your web browser and requires access to your device’s camera and audio during your virtual consultation. You agree that Doxy.me can access your camera and audio.
About the services via Zoom.us
- JUSC Medical uses Zoom.us for the purpose of interactive webinars.
- By using Zoom.us to participate in these webinars you agree to these Terms of Service and to the Terms of Service set by Zoom.us. If you do not agree to these Terms of Service, please do not use this service or website.
- Participation to JUSC Medical Webinars is preceded by payment via bank transfer.
- The provided Zoom link is personal and may only be used by the patient (and their caretakers) and cannot be transferred to someone else without notifying JUSC Medical.
- If you use our Zoom webinar facility, you must not attempt to record the webinar, whether visually or by audio or take screenshots or copies of images of that meeting.
- You must not abuse, intimidate or threaten those people using the facility or engage in behaviour which is offensive. We reserve the right to exclude you from the meeting if you fail to comply with these Terms.
- JUSC Medical aims to answer all patient questions during the webinar that relate to the subject discussed, but holds the right not to answer questions if these are inappropriate, outside scope of the subject, to personal for a group meeting/webinar, and at discretion of the presenter.
User obligations
- You will not use, or submit information to, JUSC Medical or Doxy.me in a way that would be, or materially contribute to, a breach of law in any country.
- You agree that all information you provide will be true, accurate and correct and to update us promptly if any of that information provided by you becomes outdated or is otherwise inaccurate or misleading.
Concerns or complaints
- In using the health service provided through JUSC Medical, you have the protection of the Code of Health and Disability Services Consumers’ Rights, and can also make use of the services provided by the Nationwide Health and Disability Advocacy Service.

- The website “jusc.co.nz” and “chronicfatiguesyndrome.co.nz” are owned and operated by JUSC Medical. Any reference in this Terms and Conditions to “JUSC Medical websites” covers both websites owned by JUSC Medical.
- All information, data and advice provided on JUSC Medical websites is provided for information purposes only and is not designed to be a replacement or substitute for professional medical advice. You will not rely on, and JUSC Medical will not be liable for any errors or omissions in, any of the information, data and advice provided on either website owned by JUSC Medical. This is particularly so where the information is provided to JUSC Medical by third parties. Any other websites or links that JUSC Medical provide to you it does not endorse or approve and has no responsibility for the content of. They are provided for your information only.

Limitation of liability

JUSC Medical will not be liable for any loss or damage resulting from the transmission of data through its websites or by email.
- JUSC Medical has no liability for any lack of performance, unavailability or failure of its services, the website or for any failure of JUSC Medical to comply with these Terms and Conditions where they arise from any cause beyond the reasonable control of JUSC Medical.
- To the maximum extent possible and applicable by the laws of New Zealand, under no circumstances will JUSC Medical or a doctor from JUSC Medical be held liable, for any implied warranties, Conditions or Terms, and will not be liable for any loss or damage (whether foreseen or unforeseen) relating to loss of emotional wellbeing, loss of data, loss of revenue or anticipated profits or savings, loss of business, loss of opportunity, loss of goodwill, or injury to reputation. JUSC Medical will not be held liable for losses suffered to third parties or any direct or indirect general, consequential, special or exemplary damages arising from the services provided to you regardless of the form of action.
- In return for you using JUSC Medical Services, you agree to release JUSC Medical from any claims that you may have now or later against JUSC Medical and will at all times in the future indemnify them against all proceedings, actions, claims or demands made by any person whether for personal injury, (including death and disability) or otherwise and whether occasioned by negligence, breach of a statutory duty, tort, equity, breach of contract or otherwise suffered as a result of or in connection with you using this website and facility.
- If any of these Terms and Conditions are deemed to be illegal, invalid or otherwise unenforceable, then to the maximum extent permissible the provision which is considered illegal, invalid or unenforceable shall be firstly redacted to the level where it is no longer illegal, invalid or unenforceable or, if that cannot be achieved, severed and deleted from these Terms and Conditions, but the remaining Terms and Conditions shall survive and remain in full force and effect.
- JUSC Medical may vary these Terms and Conditions from time to time without prior notice. We will post the updated Terms on the website together with the date of any update. You are responsible for ensuring that you are aware of the latest version of these Terms and Conditions. By continuing to use the websites or services of JUSC Medical, you’ll be taken to have accepted the latest version of these Terms and Conditions. If you do not wish to be bound by these Terms, you must leave the website or cancel the consultation with appropriate notice.
- These Terms and Conditions are governed by and to be construed in accordance with the laws of New Zealand and you irrevocably submit to the exclusive jurisdiction of the Courts of New Zealand.
